Requirements
-For appointment to the positions of Chairperson of the Micro and Small Enterprises Tribunal, an applicant must be in possession of the qualifications provided under Section 54(2) of the Micro and Small Enterprises Act as read with Article 166(2) and (5) and Chapter Six of the Constitution, namely:-
-a) Hold a law degree from a recognized university, or be an advocate of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction.
-b) Have at least ten (10) years’ experience as a Superior Court Judge or professionally qualified Magistrate; or
- c) Have at least ten (10) years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field; or
- d) Have held the qualifications specified in paragraphs (b) and (c) for a period amounting, in aggregate, to ten (10) years: (Note: experience may have been gained in Kenya or in any other country with a Common Law jurisdiction)
- e) Meet the requirements of Chapter Six of the Constitution on leadership and integrity. In addition, the applicants must demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment in both legal and life experiences and commitment to public and community service.
Duties and Responsibilities
-The Chairperson of the Micro and Small Enterprises Tribunal shall preside over the sitting of the tribunal. The function and jurisdiction of the tribunal are provided for under Section 55 of the Micro and Small Enterprises Act, namely, to determine disputes relating to;
- a) commercial disputes involving micro and small enterprises;
- b) failure to comply with the terms and condition of allocation of worksites;
- c) election and management of associations;
- d) failure to comply with the constitution or rules of a micro and small enterprise association or umbrella organisation;
- e) unprocedural and illegal allocation, subdivision, subletting of a micro and small enterprise worksite;
- f) mismanagement and misappropriation of funds;
- g) any other dispute acceptable by the Tribunal

(e) Five (5) samples of any professional writings, including but not limited to judgments, advocacy submissions in courts, scholarly writings or any publications that the applicant has authored. Shortlisted candidates will be required to submit valid copies of clearance certificates from the following bodies during the interview:- • Kenya Revenue Authority • Higher Education Loans Board • Law Society of Kenya • Directorate of Criminal Investigation • Advocates Complaints Commission • Ethics and Anti-Corruption Commission and • a recognized Credit Reference Bureau
- 2.
