Requirements
- For appointment to the position of Judge of the Court of Appeal, the applicant must possess the following minimum qualifications set in Article 166 (2) and (4) of the Constitution, namely:
-(a) Hold a law degree from a recognized university, or be an advocate of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction.
-Have at least ten (10) years’ experience as a superior court judge irrespective of whether that experience was gained in Kenya or in another commonwealth common-law jurisdiction; or
-(c) Have at least ten (10) years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field irrespective of whether that experience was gained in Kenya or in another commonwealth common-law jurisdiction ; or
-(d) Have held the qualifications specified in paragraphs (b) and (c) for a period amounting, in aggregate, to ten (10) years.
-(e) Meet the requirements of Chapter Six of the Constitution on Leadership and integrity.
-In addition, the applicants must demonstrate a high degree of professional competence, communication skills, fairness, good temperament, making of good judgments in both legal and life experiences and commitment to public and community service.
-The appointment shall be made in accordance with Article 166 (1)(b), (2) and (4) of the Constitution 2010 and the First Schedule of the Judicial Service Act, No. 1 of 2011.
Duties and Responsibilities
-A Judge of the Court of Appeal shall serve in the Court of Appeal of Kenya. The function and jurisdiction of the Court is provided for under Article 164 (3) of the Constitution, namely :-
- (a) To hear and determine Appeals from the High Court and
- (b) To hear and determine appeals from any other court or Tribunal as prescribed by an Act of Parliament.

- (a) A letter of application,
- (b) A detailed and updated curriculum vitae, to include background information such as community service, financial discipline, pro bono activity, involvement as a party in litigation and involvement in political activity including financial contribution to political party
-parties (if any) and criminal record, legal
-professional engagement for the last five (5) years, three (3) professional referees and two (2) character references who can verify and comment on the applicant’s past and present employment,
- (c) Applicant’s three (3) recent coloured passport size photographs,
- (d) Five (5) samples of any professional writings, including but not limited to judgments, advocacy submissions in courts, scholarly writings or any legal publications that the applicant has authored,
- (e) Declaration of income and liabilities as at the time of making the application, using the prescribed forms “The Declaration of Income, Assets and Liabilities Form JSC 2b” which can be downloaded from the following website – www.judiciary.go.ke.
- (i) Applicants from Government employment should also attach previous copies of returns of Declaration of Income, Assets and Liabilities for the last three (3) years.
- (ii) Those in private practice should attach audited accounts and tax returns, for the last three (3) years.
- (f) Certified copies of testimonials, professional certificates and academic transcripts.
- (g) Applicants should have valid clearance certificates from the following bodies:-
- • Kenya Revenue Authority,
- • Higher Education Loans Board,
- • Law Society of Kenya,
- • Directorate of Criminal Investigations,
- • Advocates Complaints Commission,
- • Ethics and Anti-Corruption Commission and
- • A recognized Credit Reference Bureau.
- (h) Shortlisted candidates will be required to carry the original clearance certificates during interview.
-(2) Applicants are also required to forward one (1) hard copy of the completed Employment Application Form (JSC 2 for non-public officers or JSC 2A for public officers) which can be downloaded from www.judiciary.go.ke (downloads) and to attach all the documents cited in item No. 1 (a to g)above.
- Applicants MUST take note that it is a criminal offence to provide false information and documents in the job application and the same will be verified by relevant bodies.
- The applications must reach the Commission NOT LATER THAN 18TH MARCH, 2019 AT 5.00 P.M.
