-For appointment to this position, an applicant must be in possession of the following qualifications:-
i) hold a law degree from a recognized university, or are advocates of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction;
ii) at least ten (10) years’ experience as a Superior Court Judge or professionally qualified Magistrate; or
iii) at least ten (10) years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field; or
iv) held the qualifications specified in paragraphs (ii) and (iii) for a period amounting, in aggregate, to ten (10) years:
v) Meet the requirements of Chapter Six of the Constitution and be of high moral character, integrity and impartiality. In addition, the applicants must demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment in both legal and life experiences and commitment to public and community service.
Experience may have been gained in Kenya or in any other country with a Common Law jurisdiction.
Knowledge and experience in aviation matters will be an added advantage.
Duties and Responsibilities
-The Chairperson of the National Civil Aviation Administrative Review Tribunal shall be responsible for:-
i) presiding over all proceedings where he
-she is present in person;
ii) participating in hearing and determination of all complaints or appeals which come before the Tribunal;
iii) carrying out inquiry into the complaints or appeals lodged including summoning witnesses, taking evidence and calling for production of books and other documents;
iv) making finding thereupon and notifying parties concerned of the awards, judgements, orders, rulings and decrees issued by the Tribunal;
v) making rules of the Tribunal with respect to the filing, hearing and disposal of complaints or appeals and other matters before the tribunal; and
vi) providing requisite leadership to ensure the Tribunal attains a high level of competiveness and ethical standards in its entire programmes.
